Supreme Court Of India and Its Landmark Cases

 

The common trend in courts is to maintain records of landmark cases and use them as a basis for determination of similar occurrences. Law students, therefore, need to have in-depth knowledge of such cases is regions where they intend to offer representation. A reflection of this is available from the supreme court of India that has made a number of landmark decision in its tenure. A case of family issues was brought to the supreme court of India and the decision remains as one of the historic ones. This happened when a famous lawyer cited religious grounds to disown his wife and children. A lower court ruled that the wide should receive Rs 25 per month as maintenance. On appeal the supreme court increased this to Rs. 179 per month stating that the law was not limited to religion.

 

Bhopal Gas Tragedy case is another landmark case that was filed in the supreme court of India. In this case, the complainant wanted the court to stop the company from producing dangerous gases and offer compensation to persons affected by the gas. The landmark cases in india was filed in court and while in progress a fatal accident occurred  killing and further injuring  a good number of people. Upon consideration of factual information, the court decided that the company should stop its production of the gases and further proceed to compensate the persons affected by the explosion and the gas.

 

Lawmakers in India from lawnn.com challenged the constitution on matters of appointment of the judges as well as their transfers. In this case, the supreme court was required to give directions on the exact powers of appointment and the bodies with powers to exercise the duty.

 

In the court's ruling, the power to appoint was given to the chief justice by the constitution and in such a way that is the office with powers of appointment.
